In Texas, felony offenses are classified as Capital, First Degree, Second Degree, Third Degree, and State Jail felonies.

Punishment Ranges

The punishment range for a felony offense is based upon the classification, and is generally as follows:

Capital: Confinement in the Institutional Division for life without parole or by death;
First Degree: Confinement in the Institutional Division for life or for any term of not more than 99 years or less than 5 years, and a fine not to exceed $10,000;
Second Degree: Confinement in the Institutional Division for any term of not more than 20 years or less than 2 years, and a fine not to exceed $10,000;
Third Degree: Confinement in the Institutional Division for any term of not more than 10 years or less than 2 years, and a fine not to exceed $10,000;
State Jail Felony: Confinement in a state jail for any term of not more than two years or less than 180 days, and a fine not to exceed $10,000.

With the exception of Capital felonies, a person may also be placed on community supervision (standard probation or deferred adjudication) and never see the inside of a prison pending successful completion of all terms and conditions of his or her probation.

At times, law enforcement officials will contact the individual being investigated for a felony offense in an effort to obtain a statement. You do not have to talk to the police.
